Terms of Use and Sale
Effective from 3 July 2026.
1. Scope
These Terms govern access to and use of https://machiavelli-shop.com/ (the “Website”), customer accounts, and distance contracts for goods offered under the Machiavelli brand. The Website is an online shop, not a marketplace on which independent traders sell goods. The seller is the company identified in section 2.
“Customer” means anyone using the Website. “Consumer” means a natural person acting outside their trade, business, craft or profession. Provisions describing special consumer rights apply to Consumers only. Nothing in these Terms limits mandatory statutory rights.
Browsing the informational parts of the Website does not oblige a visitor to buy. Before submitting an order, the Customer can review these Terms and correct entered information. Submitting an order constitutes acceptance of the version applicable to that order.

Correspondence, withdrawal notices and complaints may be sent through these electronic channels. The physical return address is provided privately after notice. For the physical return of goods, also follow the Returns and Complaints Policy.
3. Customer requirements and acceptable use
An order may be placed by an adult with legal capacity. A minor may use the Website and order only with the consent and assistance of a parent or guardian where required by law. Customers must provide accurate, complete and current information and use the Website in good faith.
Customers must not break the law or third-party rights, circumvent security, introduce malicious code, scrape content at an abnormal scale, interfere with the Website, or use another person’s account without permission.
4. Products and product information
Each product page states the main characteristics, materials, colours, available sizes, price and images. Images aim to be accurate, but minor visual differences may result from lighting, display settings or the natural characteristics of leather, suede and other materials. This does not restrict rights where the goods materially differ from their description, sample or agreed characteristics.
The size guide is for assistance. Fit varies by model and foot shape. If a Customer communicates a particular purpose or requirement before ordering and the Seller expressly accepts it, that requirement forms part of the contract.
Adding goods to the cart does not reserve them. Availability is confirmed during order processing. If an item is unavailable, the Customer will be informed without undue delay, no payment will be due, and any amount already received will be refunded.
5. Ordering and contract formation
- The Customer selects a product, size and quantity and adds them to the cart.
- The Customer provides contact details and selects an available Speedy delivery option to an office, locker or address.
- The Customer selects an enabled payment method, reviews the total price, delivery and entered information, and can correct mistakes.
- The order is submitted through the final action clearly indicating an obligation to pay.
- The Seller sends electronic confirmation to the supplied email address. The contract is formed when the Seller confirms acceptance of the order. The confirmation contains, or provides durable access to, the main order information.
Before acceptance, the Seller may reject an order because stock is unavailable, there is an obvious technical pricing or description error, there is a reasonable suspicion of abuse, delivery is impossible, or incomplete or inaccurate details remain uncorrected after an attempted contact. The Customer will be notified and sums received will be refunded. This right will not be exercised discriminatorily or contrary to mandatory consumer law.
6. Prices, reductions and payment
Prices are stated in euro and include applicable taxes. During any statutory dual-display period, prices must also be shown in the required second currency using the official conversion and rounding rules. Delivery and any other applicable charge are displayed before the order is submitted. The Customer is not liable for additional costs that were not disclosed in advance.
7. Delivery
Delivery is available within Bulgaria through Speedy to a selected office, locker or address. The usual estimate after processing and dispatch is 1–2 business days, while the specific estimate and cost are shown before order submission. Unless another period is agreed, goods are delivered without undue delay and no later than 30 days after the contract is concluded.
The Customer must provide accurate delivery information and enable receipt. If transport packaging is visibly damaged, inspecting the goods with the courier and requesting a report is recommended, but it is not a condition for exercising statutory rights.
Risk of accidental loss or damage passes to a Consumer when the Consumer or a nominated third party other than the carrier takes physical possession. Refusing or failing to collect a parcel is not a substitute for an unequivocal withdrawal notice. Repeat-delivery charges may include only costs properly disclosed and actually incurred.
8. Withdrawal and returns
A Consumer may withdraw from the distance contract without giving a reason within 14 days after receiving the goods, in accordance with Articles 50–56 of the Bulgarian Consumer Protection Act. The procedure, model form, costs and refunds are set out in the Returns and Complaints Policy, which forms part of these Terms.
Shoes may be tried on indoors on a clean, soft surface as would reasonably be allowed in a shop. The Consumer is liable only for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Missing or damaged original packaging or accessories does not automatically extinguish the right of withdrawal, but may be considered where it demonstrably reduces value.
9. Conformity and complaints
The Seller is liable for a lack of conformity existing on delivery and becoming apparent within two years, under the Bulgarian Act on the Supply of Digital Content and Digital Services and on the Sale of Goods. A lack of conformity appearing within one year is presumed to have existed on delivery unless proved otherwise or unless that presumption is incompatible with the nature of the goods or the lack of conformity.
For a valid claim, the Consumer may request free repair or replacement unless the selected remedy is impossible or disproportionate. For goods without digital elements, this must be completed free of charge, without significant inconvenience and within one month after notification. A proportionate price reduction or contract termination is available in the statutory circumstances; termination is unavailable for a minor lack of conformity.
A complaint may be submitted by email, through the contact form, stating the order, goods, issue, preferred remedy and contact address, with available proof of purchase and non-conformity. Complaint rights are separate from the 14-day withdrawal right.
10. Accounts, wishlist and security
An account is not required to browse the Website. It enables management of profile data, order history and wishlist items. Customers must protect their access credentials and notify the Seller of suspected unauthorised access. The Seller may temporarily restrict an account where necessary for security, abuse prevention or a breach of these Terms, while providing legally required information by an appropriate means.
11. Intellectual property
Text, photographs, videos, graphics, logos, trade names, design, databases and software on the Website are protected and belong to the Seller or are lawfully licensed. Personal, non-commercial browsing is allowed. Reproduction, systematic extraction, distribution, modification or commercial exploitation without a lawful basis or prior written permission is prohibited.
12. Accessibility, operation and external services
The Seller uses reasonable care to keep the Website secure and available, but maintenance, technical interruption or events outside its reasonable control may occur. Nothing excludes liability that cannot legally be excluded. External links and services, including courier services, are operated by their providers; the Seller remains responsible for its own contractual duties.

13. Personal data and cookies
Personal-data processing is described in the Privacy Policy. Cookies, similar technologies and available choices are described in the Cookie Policy and Settings.
14. Liability and force majeure
Each party is liable for culpable non-performance in accordance with law. The Seller is not liable for delay or failure caused by an unforeseeable and unavoidable event beyond its reasonable control for as long as that event continues, but will inform affected Customers and take reasonable mitigation measures. If performance becomes impossible or loses its purpose for the Consumer, applicable termination and refund rights remain available.
Nothing excludes or limits liability for intent or gross negligence, death or personal injury, defective products, breach of mandatory consumer rights, or any other liability that cannot legally be limited.
15. Changes
The version governing an order is the version available and accepted when that order was submitted. Later amendments do not retrospectively alter existing contracts. The Seller may update these Terms for legal, technical or organisational reasons by publishing the new version and its date.
16. Governing law and disputes
Bulgarian law applies. A Consumer habitually resident in another country is not deprived by this choice of protections provided by mandatory provisions that would apply in the absence of this choice. The parties should first try to resolve disputes in good faith, without limiting complaint or court rights.
A Consumer may complain to the Bulgarian Consumer Protection Commission and, after first referring the dispute to the Seller, may request voluntary out-of-court proceedings before the appropriate conciliation commission. The former European Online Dispute Resolution platform has been discontinued and is not presented as an available remedy. Court jurisdiction is determined under applicable procedural law; these Terms impose no exclusive local jurisdiction to a Consumer’s detriment.
